Deadly Force and Protecting Property in Nebraska

In Nebraska, you can use deadly force in a self-defense situation as long as its used on reasonable grounds. If someone genuinely believes they are being threatened with death, serious bodily harm, kidnapping or sexual intercourse, even if later its proven that belief was mistaken, they can use deadly force to protect themselves under Nebraska law. The defendant would need to believe, in good faith, that the use of deadly force be immediately necessary and justified under the circumstances. Thus if a defendant is asserting self-defense as a justification for the use of such force, they must prove:

  1. The force was necessary and in good faith
  2. Deadly force had to be immediately necessary
  3. The force had to be justified under the situation.
