Top 10 Bankruptcy Do’s & Don’ts: 5. Do Include All Your Creditors

When you sign your bankruptcy pleadings you are swearing and affirming that the information in those pleadings is true and accurate to the best of your knowledge. It is important to make sure that each and every one of your creditors is listed on your bankruptcy.

We know that sometimes that is easier said than done. We see creditors buying and selling our client’s old debts all the time. It can get hard to keep track of it all. Nonetheless, you should try your best to be prepared and ensure each and every creditor is listed.

At your drafting appointment we will try to pull all three of your credit reports at the truly free credit report website www.annualcreditreport.com. Information regarding your creditors can also be found on sites like Credit Karma and Credit Sesame.

Additionally, you should start saving all of your bills, if you haven’t been doing so already. A lot of people will just start keeping them in a shoebox or a drawer at home. Then make sure to submit those bills to your attorney so they can be included in your petition.

If you submit a recent credit report and all of the bills in your possession, you should be fine. However, if you end up omitting a creditor and encountering the need to amend your pleadings it may cost you more in court filing fees and/or attorney fees. Nonetheless, that is what we are here for.
